The buying process

The process of buying a property in Spain is slightly different from that in the Netherlands. The notary's duty of care is less extensive in Spain and the payment of the house does not go through a trust account of the notary. 25. buying processPayment of the purchase price is made directly between buyer and seller with both parties being legally assisted by a lawyer. The role of a lawyer is therefore essential in Spain, especially as they also check whether the property can be transferred to you without any financial burden (e.g. outstanding debts from a mortgage or utilities from the previous owner).

To sign a purchase contract, for example, you will need a Spanish identification number for foreigners, called the NIE number (Número de Identificación Extranjero). A Spanish bank account is also required before you can buy a property. The purchase contract sets out all agreements and obligations between the parties regarding the purchase and sale of the property in question.

In the event of a successful transfer between buyer and seller, we as estate agents receive a commission from the selling party for our services. In Spain, it is customary for buying and selling brokers to work together, so portfolios of properties on offer are also shared between them.
